Client Booking Terms


All clients (ie: production & casting personnel) should read this carefully before booking an artist.

 

Once an artist is introduced to a client by way of submission and/or casting/shoot, Young Artists Management are to act as agent to that artist regardless of any subsequent requirements for the artist to fulfill the said assignment. Likewise, any repeat jobs and correspondence regarding that artist is to be with Young Artists Management solely. It is understood that booking an artist from Young Artists Management is in acceptance of this understanding until otherwise agreed between client and Young Artists Management as agent.

 

PAYMENT TERMS

All invoiced payments are required within 30 days of the date of invoice. In all cases the person booking the artist will be invoiced and solely responsible for payment, unless otherwise agreed at the time of the booking. All fees are to be negotiated only with Young Artists Management. We reserve the right to invoice the ‘ultimate client’ (i.e. designer/manufacturer/owner of the product in question).

 

EXCLUSION FEES

A special fee will be negotiated when the work is in conjunction with a product, which precludes work for competing products. It is the client’s responsibility to check whether conflicting work has been done. If an artist advertises a product, he/she is able to work for any competitor unless an exclusion fee is negotiated.

 

PROVISIONAL BOOKINGS

Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if a definite booking is offered and the provisional cannot be confirmed.

 

CANCELLATIONS

If a booking is cancelled within 24 hours of the starting time, the full fee will be charged unless the same artist is re-booked within 24 hours, in which case half the fee is charged. Saturdays, Sundays and Bank Holidays are excluded from these calculations. However, if a booking is cancelled due to illness or some other reason beyond the artists or agencies control (and upon the production of the appropriate evidence) the artist shall not be liable for cancellation charges. This is a reciprocal arrangement between artists and client.

 

WEATHER PERMITTING BOOKINGS

At the first cancellation, a half-fee is charged unless the client fails to cancel in time to prevent the artist's attendance, when the full fee is payable. At the second cancellation, the full fee is charged.

 

MEALS

Clients are responsible for artists meals, unless client requests child/parent to bring along a packed lunch or otherwise beforehand, at the time of booking.

 

TEST & EXPERIMENTAL PHOTOGRAPHY

A Photographer is not entitled to use test and experimental photographs for commercial purposes unless specific arrangements have been made before the photographic session.

 

INSURANCE

The client is responsible for the artist’s health and safety when the artist is travelling, or providing services, in connection with the booking to the same extent as if the artist were an employee of the client. The client will maintain adequate insurance cover to underwrite its obligations to the artist. The agent is not responsible if the artist fails to attend the booking. The client is advised to insure against any losses, which might result if the artist does not keep a booking because of ill health, or some other reason.

 

JURISDICTION

These terms and conditions for booking and all other matters connected with the booking are governed by Irish law and any dispute will be settled in accordance with that law by a court in Ireland.

 

COMPLAINTS

Any cause for complaint should be reported to the Agency when it arises. Complaints cannot be considered in retrospect.

 

YOUNG PERSON’S EMPLOYMENT ACT 1996

Children under 16 years of age require a licence for paid performances. Clients must adhere to all conditions as set out in the licence. Please note to put a licence in place takes a minimum of 5-10 working days.


DISCLAIMER OF LIABILITY

Whilst every endeavour is made to provide satisfactory and efficient service to our clients, we cannot be held responsible for an artists conduct on an assignment. We reserve the right to negotiate within the structure of these Terms & Conditions.

It is the clients responsibility to arrange insurance if indemnity is required against an artists inability to attend through sickness or unforeseen circumstances.

 

PLEASE NOTE

As the supplier of services, these Terms and Conditions take precedence over any Terms and Conditions, which may be received from the client even if those Terms and Conditions have a clause similar to this.

 

All fees are to be negotiated only with Young Artists Management.

 

It is not permitted for a client to have direct contact with an artist/parent without prior arrangement by the agency and in writing. Any arrangements made with, or contractual obligations agreed to, by the artist, with the client and without the written agreement and/or knowledge of the agency will not stand and Young Artists Management accepts no culpability for such agreements.

 

Whilst every endeavour is made to provide a satisfactory and efficient service to our clients we cannot be held responsible for an artists conduct on an assignment.

 

We reserve the right to negotiate with the structure of these Terms and Conditions.




POLICY REGARDING THE EMPLOYMENT OF MINORS


All clients must adhere to the following policy regarding the employment of minors:


Supervision

No minor should ever be unsupervised while on set or when they are under the care of the production team.

Chaperone

A chaperone is required to accompany all minors when they are working for the production company. Ideally, the parent or legal guardian of the child should accompany the child on set at all times. In the event that this is not possible, a suitably qualified chaperone (preferably a person who is known to the child) who has been fully vetted may supervise the child while on set in accordance with the requirements as set out by the Department of Trade, Industry and Employment.

 

Licence

A licence must be obtained from The Department of Trade, Industry and Employment prior to the employment of a child up to 16 years of age. Employers must adhere to all requirements as set out by The Department of Trade, Industry and Employment.

 

Working Hours

In accordance with the Protection of Young Persons (Employment) Act 1996 the following working hours must be adhered to by the production company, employer or to whomever is responsible for the minor at work, at all times.

 

Children under 7 years of age

A child under 7 years may not be present at the place of employment

-            for more than 5 hours a day,

-            before 09.30 a.m. or after 4.30 p.m. except in special circumstances

-            may not be present at the place of employment for more than 250 hours in any twelve month period.

-            may not take part in a performance or rehearsal on any day: for a continuous period of more than 30 minutes without an interval for rest, for a total period of more than 2 hours.

 

Children over 7 and under 13 years of age

A child between 7 and 13 years may not be present at the place of employment

-            for more than 71⁄2 hours a day, or

-            before 9 a.m. or after 5 p.m. except in special circumstances

-            may not be present at the place of employment for more than 700 hours in any twelve month period.

-            may not take part in a performance or rehearsal on any day: for a continuous period of more than 45 minutes without an interval for

rest, for a total period of more than 3 hours.3.           

 

Children over 13 years of age

A child over 13 years shall not be present at the place of employment

-            for more than 8 hours a day, or

-            before 9 a.m. or after 7 p.m. except in special circumstances.

-            may not be present at the place of employment for more than 900 hours in any twelve month period.

-            may not take part in a performance or rehearsal on any day: for a continuous period of more than 1 hour without an interval for rest, for a total period of more than 4 hours.

 

Night work

A child may take part in a performance after the latest relevant hour permitted only if it is essential for such performance to take place after that hour.

 

Meal/rest breaks

(1)            A child must have a break for a meal of at least 1 hour and a separate 15 minute rest break for each period of 31⁄2 hours at the place of employment.

(2)            A child may not take part in performances or rehearsals on more than 5 days in any 7 day period (or 6 days in any 7 day period provided such performances or rehearsals do not take place on more than 20 days in any 28 day period).

 

Illness or injury :

At no time should a child perform when unwell. If a child falls ill or is injured while on set, medical assistance must be obtained and the parent/guardian of the child must be informed immediately. The chaperone should always know who to contact in a medical emergency and should be made aware of any medical conditions relating to the child and any health and safety issues while on set.

 

Education

In accordance with the The Department of Trade, Industry and Employment, where the hours of work of the child involve an absence from school of more than one week, appropriate alternative teaching arrangements must be arranged.

 

Place of performance/rehearsal and arrangement for getting home

In accordance with the The Department of Trade, Industry and Employment, the employer is responsible for ensuring the following:

(1)            The employer shall ensure that at the place of performance or rehearsal, suitable arrangements have been made for adequate meals for the child, or the child to dress for performances or rehearsals and for the child’s rest and recreation when not taking part in a performance or rehearsal, and that suitable and sufficient sanitary and washing facilities are provided.

(2)            The employer shall not require the child to take part in a performance or rehearsal which requires the child to be nude or partially nude without the express permission of the parent or guardian. A qualified nurse or social worker shall be in attendance during any such rehearsal or performance.

(3)            The employer shall ensure that arrangements, acceptable to the parent or guardian, are made for the child to get to his/her home or other destination after the last performance or rehearsal on any day.
