Agreement
TERMS
AND CONDITIONS
This service is provided by YOUNG
ARTISTS MANAGEMENT, of 18-19 College
Green, Dublin 2, Ireland. Please read
this Agreement carefully as it sets out
your rights and obligations with respect
to your representation with YOUNG
ARTISTS MANAGEMENT. This Agreement (the
"Agreement") is a legal Agreement
between you (the "Artist") and YOUNG
ARTISTS MANAGEMENT (the “Agency”). If
the Artist is under the age of 18, the
term “Artist” shall refer to the Parent
or Guardian of the Artist. By
registering with YOUNG ARTISTS
MANAGEMENT you agree to the following
terms and conditions.
This Agreement constitutes the entire
understanding and Agreement between the
Artist and Young Artists Management with
respect to the subject matter hereof. If
any provision of this Agreement shall be
held to be invalid, illegal, or
unenforceable, the validity, legality,
and enforceability of the remaining
provisions shall not be in any way
affected or impaired thereby. Young
Artists Management shall not be liable
for any delay or failure in performance
under this Agreement or interruption of
service resulting from acts of God,
civil or military authority, war, labour
disputes, materials provided by third
parties, or any cause beyond the
reasonable control of Young Artists
Management. Except as described herein,
the Artist may not assign this Agreement
without the consent of Young Artists
Management
DISCLAIMER OF WARRANTY
The use of services provided by Young
Artists Management is at the Artist's
own risk. Young Artists Management
provides services without warranty of
any kind, either express or implied,
including but not limited to warranties
of title or non-infringement or
warranties that the services provided by
Young Artists Management are free from
defects, merchantable or fit for a
particular purpose. Young Artists
Management make no warranty that the
services will meet Artist's
requirements, or that the services will
be uninterrupted, timely, secure, or
error free; nor does Young Artists
Management make any warranty as to the
results that may be obtained from the
use of the services or as to the
accuracy or reliability of any
information obtained through the
services.
VETTING RIGHTS
Young Artists Management reserves the
right to vet all applicants wishing to
join the agency. This may include, but
is not limited to requesting character
references from people involved in the
Industry.
REFUSAL RIGHTS
Young Artists Management reserves the
right to refuse membership to its
services. Young Artists Management will
not enter into discussion as to why a
submission has been refused. The
decision to refuse a submission is
final.
CONSENT
The Artist grants to Young Artists
Management all necessary performer
consents including consent under the
Performers Protection Act 1968 and
otherwise to enable Young Artists
Management to act as an agent for the
artist. Young Artists Management
undertakes to communicate between the
Commercial Client (normally a Production
Company or Casting Director) and the
Artist. In order for Young Artists
Management to function properly as an
agency in representing the Artist, the
Artist authorises Young Artists
Management to negotiate contracts on
their behalf and give consent to such
contracts by signing on behalf of the
Artist upon instruction.
TERMINATION and MODIFICATION OF
AGREEMENT
The Artist may terminate this Agreement
at any time by notifying Young Artists
Management in writing to the above
address. Young Artists Management may
terminate this Agreement at any time for
any reason, with or without prior notice
and Young Artists Management shall have
no further liability to the Artist
whatsoever. Should the Artist object to
any terms and conditions of this
Agreement or any subsequent
modifications thereto or become
dissatisfied in any way with the
services provided by Young Artists
Management, the Artist's only recourse
is to discontinue immediately use of the
Services. Without restricting the
ability of Young Artists Management to
rely on other remedies that may be
available, Young Artists Management will
suspend or terminate the Artist's
account at their absolute discretion if:
Young Artists Management suspects the
Artist is breaching any term of this
Agreement or that the Artist is acting
in a manner that is detrimental to the
conduct of Young Artists Management’s
business. Young Artists Management
reserves the right of sole discretion to
modify or discontinue the services
offered by it, or any portion thereof,
at any time, with or without notice to
the Artist. Young Artists Management
shall not be liable to the Artist or any
third party should Young Artists
Management exercise its right to modify
or discontinue the services offered by
it. In the event of termination of this
agreement, following the commission
term, Artist shall pay agency commission
("post term commission") with respect to
any earnings arising directly or
indirectly from work obtained during the
term of this agreement, including but
not limited to, repeat fees, residuals,
franchises, sequels, prequels,
extensions, re-runs, and any future work
obtained as a result of any of the
services provided during the term of
this agreement.
AUDITIONS & OFFERS OF WORK
Auditions and offers of work to the
Artist will be communicated to the
Artist by Young Artists Management.
Young Artists Management undertakes to
use all reasonable endeavours to promote
the Artist. However, Young Artists
Management cannot guarantee the amount
of work or auditions for work that the
Artist may obtain as a result of their
agreement with the agency. In line with
the Department of Trade & Industry's
rulings, it should be stressed that no
agency can guarantee work for an artist
on their books. The selection for any
part is not made by Young Artists
Management; it is always made by the
casting director (or the commercial
client). Our policy, however, is to only
accept those that we feel would be
excellent candidates for our commercial
clients and would only be an asset to
our agency. Young Artists Management
will act as a means of communication
between the commercial client and the
artist in respect to auditions and
offers of work. If an artist is
successful as a result of attending an
audition, they will be notified by Young
Artists Management. Normally this
happens within a 2-3 week period, but in
certain cases may take longer.
Successful artists are often shortlisted
and called back for additional
auditions. It is our policy to notify
unsuccessful artists if they have been
shortlisted for a role or have attended
a call back audition. If an artist is
unsuccessful following the initial
audition, they will often not be
notified.
TERMS OF EMPLOYMENT
The Artist undertakes when working for
the Commercial Client (normally a
production company) as far as possible
to comply with the punctuality and other
reasonable requirements of the
commercial client and to conduct
themselves in a proper and professional
manner. If Young Artists Management
obtains any complaints in relation to
the work of the Artist whether arising
out of failure to turn up, punctuality,
conduct or otherwise, Young Artists
Management shall be entitled to decide
to discontinue their services to the
artist and remove the Artist from the
Database. This decision shall be final.
AGENCY COMMISSION
Where Young Artists Management acts as
an agent for the artist, the agency
shall be entitled to deduct from moneys
received by any work obtained, an Agency
fee of up to 20%. Our current agency
commission ranges from 10% to 20%
depending on the type of work as
follows: Theatre/Radio work = 10%;
Television/Film work = 15%;
Commercials(t.v. and radio)/Print
Advertising/Modelling work = 20%. We
reserve the right to modify these fees
at any time. Where Young Artists
Management acts as an agent for the
artist, Young Artists Management will
invoice the Commercial Client (usually a
production company). When Young Artists
Management is paid by the commercial
client, they will pay the Artist the
amount due less any deductions that may
have been made for PAYE, PRSI or other
fees or taxes due. The artist shall
receive a clear record indicating all
deductions that have been made. In
certain cases, where the Artist is paid
directly by the Commercial Client
(usually in the case of theatre work),
the Artist will be invoiced by Young
Artists Management and obligated to
forward the appropriate agency fee to
Young Artists Management.
USE OF PHOTOGRAPHS
You grant Young Artists Management,
Photographer and Assigns, without
further consideration or remuneration,
your permission to use and licence any
photograph that has been created by
Young Artists Management (and those
person’s acting with Young Artists
Management’s permission) for use on
Young Artists Management’s website and
in any media for any purpose which may
include, among others, publicity,
advertising, promotion and marketing of
any kind in perpetuity worldwide. You
also grant Young Artists Management
permission to use any photograph that
has been submitted by you on the
agency’s website or on any literature,
brochures and any other material of a
marketing or sales nature, which Young
Artists Management may commission or use
from time to time. All photographs are
checked on being uploaded to the agency
website. No photographs other than
personal photographs clearly displaying
the artists face will be permitted on
the site. Photos of poor quality,
photos which are deemed offensive,
violent or obscene will not be accepted.
Young Artists Management reserves the
right to reject or remove any photograph
that does not comply with these Terms or
where we judge the photograph not to be
of a good standard.

PRIVACY
POLICY
Our service is designed to capture
personal details in order that third
parties wishing to recruit actors,
models, voice-overs, movie extras or
performers may recruit you. Therefore,
on registering with Young Artists
Management, you are required to supply
specific details which describe your
personality, physical appearance, vocal
quality, experience and relevant skills.
This information is used on the Artist’s
profile page of our website in order to
notify Casting Directors and Industry
Personnel about the services provided by
Young Artists Management. Industry
personnel are entitled to share such
information (including, without
limitation, by forwarding portfolio URLs
containing information) for project
specific professional purposes. Please
note that we exercise the strictest of
security measures when taking bookings
for children through our web-site and
that generally the site is used as an
up-to-date reference for our already
established clients. We also do not
display any contact details or personal
information other than physical details
and a brief biography provided by the
parent/guardian of the artist. In the
case of children, the parent/guardian
may choose to use an alias for the
artist or to keep the surname of the
artist private. YOUNG ARTISTS MANAGEMENT
does not engage in the practice of
distributing contact information to
third parties without your consent.
DISCLAIMER OF LIABILITY
In no event will Young Artists
Management or its employees,
distributors, distributees, suppliers,
business associates, advertisers,
directors or agents (collectively
"affiliates") be liable for any
indirect, special, incidental or
consequential damages arising out of the
use, installation or the inability to
use the services provided by Young
Artists Management, even if Young
Artists Management or its affiliates
have been advised of the possibility of
such damages. Young Artists Management
accepts no responsibility and shall not
be liable for any consequences that are
alleged to have occurred through the
Artist's use, or misuse, of the services
provided by Young Artists Management.
